Throughout these terms, "we," "us," and "our" refer to Louisiana Weddings Magazine and IDES. If you do not agree to these terms, you must not use our Website or services.
2. The Directory & Advertising (For Vendors)
Accuracy: Vendors are solely responsible for ensuring their profile information, images, and links are accurate, lawful, and up-to-date.
Subscriptions & Payments: Directory listings and advertising packages are billed according to the tier selected at checkout. By purchasing a subscription, you agree to recurring annual or monthly billing.
Cancellations & Refunds: You may cancel your directory subscription at any time. Cancellations will take effect at the end of the current billing cycle. All payments are non-refundable, and no prorated refunds will be issued for partial terms.
Right to Refuse: We reserve the right, at our sole discretion, to remove, edit, or refuse any vendor listing or advertisement that does not meet our quality standards, aesthetic guidelines, or brand values, without a refund if the vendor violates these Terms.
3. User-Submitted Content (Real Weddings, Photos & Reviews) By submitting content (including but not limited to photos, stories, reviews, and text) to Louisiana Weddings Magazine:
License: You grant us a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use, publish, reproduce, and display the content on our Website, in our print publications, and across our social media channels.
Warranty of Ownership: You represent and warrant that you own the rights to the content or have obtained all necessary, legally binding permissions (including express written consent from the professional photographer and any individuals in the photos) to submit it to us for publication.
Indemnification (Your Protection): You agree to indemnify, defend, and hold harmless IDES, Louisiana Weddings Magazine, and its owner from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from copyright infringement, rights of privacy violations, or any other legal claims related to the content you submit.
4. Contests and Voting Votes for any contests (such as "Cover Couple" or regional spotlights) must be cast by real human individuals. The use of bots, automated scripts, paid voting farms, or any other manipulative tactics is strictly prohibited. We reserve the right to verify the validity of all entries and to immediately disqualify any entrant or vendor who tampers with the voting process, at our sole discretion.
5. Disclaimers (The "Not Our Fault" Clause) THE WEBSITE, DIRECTORY, AND ALL CONTENT ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE ARE A PUBLICATION AND ADVERTISING DIRECTORY ONLY. WE ARE NOT A PARTY TO ANY CONTRACT, TRANSACTION, OR DISPUTE BETWEEN A BRIDE/GROOM AND A VENDOR. WE DO NOT ENDORSE, VET, OR GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF THE SERVICES PROVIDED BY VENDORS LISTED ON OUR SITE. YOU USE HIRED VENDORS ENTIRELY AT YOUR OWN RISK.
6. Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IDES OR ITS OWNER BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM YOUR USE OF THE WEBSITE, RELIANCE ON DIRECTORY INFORMATION, OR VENDOR NON-PERFORMANCE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
7. Governing Law and Jurisdiction This Agreement shall be governed in accordance with the laws of the State of Louisiana, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Rapides Parish, Louisiana, and you hereby consent to the personal jurisdiction of such courts.
